UK Legal Debate – How the Process of Law Unfolds
The UK has a deep foundation of traditional legal theory, law making and jurisprudence that is virtually impossible to contain in legal textbooks, the subject is so dense, and as the world unfolds and moves forward at a breakneck speed the truth is the law finds it very difficult to keep up.
So what tends to happen is the subject falls back to legal debates where the issues can be identified and expounded upon and gradually an understanding will emerge of how the new situations can be interpreted within the spirit of the law.
But, even after all this when one of these so-called new situations presents itself in front of the judge, all this can be undone depending on how he or she chooses to see things. Archaic and slow, yes but undoubtedly interesting too.
